How would you go about suing a private school on dismissal because of IEP discrimination?

My niece, who has just been asked to leave her private school, was dismissed due to supposedly bad grades. The school started threatening dismissal only when they realized that in the past she had an IEP. Her grades are very debatable because of the standards she was judged on. She had one teacher who did not hold a teaching degree, nor had he had any teaching experience ever before. He failed her when she asked for help and did her work diligently. I also am very aware of a student in her class who was passed by the same teacher who failed my niece. This other student missed over half the year in classes, all her midterms and finals, and has skipped many assignments and tests she has been asked to complete. The midterm and final policy state that if they are not made up within 10 days, they become marked as failing. This girl has never been warned or dealt with any problems with the school concerning her failing grades. However she has never had an IEP that the school has known of.

    Get an attorney. Make sure there is plenty of documentation. Have your neice write down every thing she remembers about all of this, or record it. Start a journal. Record names, dates and times of all discussions with anyone about this situation.
